Parents in California are required to support their children. Child support is awarded to ensure that both parents are contributing to the financial support of their children. Generally, child support is payable until a child reaches the age of 18, if they are graduated from high school, or until the age of 19, provided they are enrolled full-time as a high school student. There are exceptions to this general rule, one of which is that parent may be obligated to continue to support an adult disabled child who is not self-supporting.
There is a guideline formula that is used in California to determine if and how much child support should be paid by one parent to the other. Certain factors are important to this guideline calculation, such as the amount of money each parent earns or is capable of earning, the amount of time each parent spends with the child, and whether there are any hardships or special circumstances that justify deviating from a guideline child support order.
At FERNANDEZ and FERNANDEZ, we understand the nuances of California child support laws, including those factors that can affect the ultimate amount of child support. We assist and educate our clients, whether they are paying or receiving child support, so that child support laws can work for best for them and their children.
