Spousal Support:

For couples facing divorce, the amount and duration of spousal support they may be ordered to pay or that they receive is a primary concern.  In California, there are two types of spousal support.  The court may order temporary spousal support during the pendency of a divorce case.  This amount is ordered only until the divorce is final and a permanent or judgment spousal support order is made.

A spousal support award is based upon several factors.  These factors include, but are not limited to, the respective incomes of the parties, the age and health of the parties, the marital standard of living, the relative education, training and job skills of each party, the length of the marriage, whether or not there was ever domestic violence in the marriage, the tax consequences of a spousal support award, periods of time when either party did not work outside the home to attend to domestic duties and other factors that the court deems to be important, relevant and equitable.

At FERNANDEZ and FERNANDEZ, we have litigated and settled many spousal support cases, including those where we represented the party paying support and cases where our client was the party receiving support.  We have the experience and skill to achieve the most beneficial results possible for our clients, regardless of gender.
